  
Great Bend at Butler Basin is the first residential community located on the Tennessee River in Huntsville, Alabama. Nine of the homeowners will actually own land down to water’s edge of the Tennessee River. Thirty-eight of the homeowners will own land (a lot) or a townhome with water access. As owners, they will be governed by a set of restrictions recorded at the Madison County Courthouse. A signed and/or recorded copy of these restrictions and other documents listed below will be available to all homeowners prior to contracting, and it is, of course, encouraged, as with any investment, that these be read carefully. These restrictive covenants are for the protection of the homeowners. If you are the one owner who might want to do a boat repair shop out of his garage, you may think the Restrictions are too restrictive. But most homeowners, I think, would agree that basic restrictions protect one’s investment in an upscale community as Great Bend at Butler Basin. Some of the most commonly asked questions involve minimum house size (which is 2800 sq. ft.), and if there is an architectural review committee (yes).
In addition to the restrictions which are a recorded document, there are three more documents relating to Great Bend at Butler Basin. All three documents have to do with the association which basically manages the common grounds and the Yacht Club. The first document of the Association is the Articles of Incorporation of Great Bend Yacht Club, Inc. This is basically a recorded document which establishes the Great Bend Yacht Club as a legal entity. The purpose for which the Yacht Club is organized is to engage as a non-profit organization, to acquire, own, maintain and manage the common areas and marine facilities of Great Bend at Butler Basin and to exercise all the powers and privileges and to perform all the duties and obligations of the Yacht Club as set forth in the By-Laws of the Yacht Club.
This brings up the last two documents which are associated with the Association (Great Bend Yacht Club). These two documents are not recorded and can be changed by the proper vote of the membership at anytime. These documents consist of the By-Laws and Rules and Regulations. These two documents basically get into the everyday operation of the Great Bend Yacht Club, and as said, can be changed, as required, to meet the needs of the membership. Since this author and developer is a boater himself, and has a home at Great Bend, every effort has been made to make all the documents as unobtrusive as possible, yet protect the property values and enjoyment of the membership.
